About us
BloopCRM is provided by BLOOP CRM LIMITED, a company registered in England and Wales (company number 17185904). Registered office: Belmont Suite, Stowe House, St Chads Road, Lichfield, WS13 6TJ. Contact: admin@bloopcrm.com.
The service
BloopCRM is a platform for businesses to manage enquiries, appointments, projects and customer communication. These terms apply to businesses using BloopCRM and the people they invite. A business accepts these terms when it creates its company account, and acceptance is recorded.
Accounts
- Businesses are responsible for the accuracy of the data they hold in BloopCRM, for keeping login details secure, and for the actions of the users they invite.
- Each business remains the controller of its customers' personal data. BLOOP CRM LIMITED processes that data on the business's behalf, as described in our Privacy Policy.
Fees and payment
- BloopCRM is provided on a monthly subscription.
- Some optional add-ons carry an additional fee, agreed with BLOOP CRM LIMITED before the add-on is switched on.
- Fees are invoiced monthly and payable within 30 days of the invoice date.
- We may suspend access to an account with fees overdue by more than 30 days, after giving notice.
- We will give at least 30 days' notice of any price change.
Messaging and consent
Businesses must only contact people who have given their contact details and agreed to be contacted. Examples: submitting an enquiry form, or giving details to the business directly by phone or in person.
- Messages must relate to the recipient's enquiry, appointment or project. Promotional messages may only be sent to people who have agreed to receive them.
- Opt-out requests must be honoured promptly and recorded in the platform, which then blocks further messages, including automated ones.
- Messages must not contain unlawful, deceptive or abusive content, and must not be sent to contacts from purchased or third-party lists.
WhatsApp
Businesses that connect a WhatsApp number must also follow Meta's WhatsApp Business Terms of Service and WhatsApp Business Messaging Policy, including their opt-in rules.
- Meta charges the business directly for WhatsApp messages, using the payment method the business adds in its Meta account. These charges are separate from BloopCRM's fees.
- Meta may restrict or suspend a business's WhatsApp access under its own policies. BLOOP CRM LIMITED is not responsible for Meta's decisions.
Acceptable use
The platform must not be used to store or send unlawful content, to infringe anyone's rights, or to try to access another business's data.
Suspension and closure
- We may suspend or withdraw features, including messaging, from a business that breaches these terms.
- A business can close its account at any time by emailing admin@bloopcrm.com. The subscription ends at the end of the current billing month.
- A business can request an export of its data before closure. Its data is deleted within 30 days of closure.
Liability
- We provide the service with reasonable skill and care.
- We are not liable for indirect or consequential losses, including loss of profit, business or data. We are also not liable for the acts or failures of third-party services such as Meta, Google or Amazon Web Services.
- Our total liability in any 12-month period is limited to the fees paid to us in the 12 months before the claim.
- Nothing in these terms limits liability that cannot be limited by law, including for death or personal injury caused by negligence, or for fraud.
Changes to these terms
We may update these terms. Material changes will be communicated to businesses at least 30 days before they take effect.
Law
These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
